Amendment of the NEV Northern Light Agreement: Procedures for Civil and Criminal Trials

Vessel: Northern Light
DTG: 2322-04-23
Revision: 1.3 (additions and redactions from the previous revision have been highlighted and stricken out, respectively.)
Department heads of the appropriate sector(s) must approve and make use of the policies outlined in the following amendment.

The following has been decreed according to the majority will of the Captain's Board of the NEV Northern Light with a significant stake in the NEV Northern Light. This ruling is formally enacted immediately upon approval by the Board.

Procedures for Civil and Criminal Trials

The following is a proposed change to the Agreement to allow for the provision of orders or punishments which would last beyond the shift in which they are issued, be those orders or punishments of Criminal or Civil nature, in those cases it is deemed appropriate by the relevant Head of Staff of the accused and Captain:

  • In the event of a trial being called where action must be taken, the Captain will preside as Judge. A tribunal is to be called with a jury consisting of 3 people unrelated to the cause of the trial. In the event that this cannot be done, the Captain shall preside as both Jury AND Judge. If a Captain is not available due to absence on shift, or due to emergencies requiring their immediate attention, these duties may be yielded to a trusted and active First Officer, until such time that the Captain chooses to resume these duties.
    • In the event the Captain holds a special interest in the outcome of the trial, the Captain shall make a reasonable effort to eliminate that interest for the duration of the trial, or elect someone else to preside over the trial if that is not possible.
  • The Prosecutor, ideally, shall be a Bridge Officer who shall be informed of all charges and shall receive all evidence related to the charges brought against the defendant so as to allow the Prosecutor to make the best case possible. If a Bridge Officer is unable to perform this duty, or if there is a lack of Bridge Officers to perform this duty, the reponsibility will fall to the following employees in this order: Aegis Inspector, Aegis Gunnery Seargent, Aegis Commander, and Aegis Operative. The accused's entitlement to defense as noted in the court procedures shall not be infringed.
  • If the defendant is convicted, the Captain and the relevant heads of staff shall jointly decide on a punishment. This punishment shall persist from shift to shift until it is completed.
  • In the event of a Head of Staff being convicted of their crime, then the Captain alone shall decide punishment - if he is unavailable, this duty shall not be passed to the First Officer. However, a permanent demotion persisting beyond the length of the shift requires either the written consent from the appropriate department head or an unanimous vote by heads from every other department to take effect.
